Tharmendran's appeal to stop jet engine theft trial dismissed (Updated)

SHAH ALAM: The case of Royal Malaysian Air Force sergeant N. Tharmendran, who is accused of abetment in the theft of two F-5 jet engines, will resume on Dec 28 after he failed to obtain a permanent stay of proceedings.

A High Court here on Friday dismissed the stay application after finding that the applicant did not prove any outside intervention in the court process.

Judicial Commissioner Asmabi Mohamad said the reports and evidence provided in court failed to prove that the applicant was interrogated by the air force but instead by the police.

Tharmendran's lawyer N. Surendran had previously submitted to court that his client was tortured during custody by the air force.

Asmabi said the applicant was prosecuted in court after police concluded its investigation and the air force was not involved in the prosecution.

She, however, recommended that the applicant file a civil suit against two air force majors who allegedly committed the torture.

Among other points raised by the defence was the delay in prosecution, which Asmabi rebutted, as there was no law that specified a period in which an arrest must be made.

Tharmendran was arrested in July last year and charged in court in January.

“There is no time limit. The prosecution has the right to charge at any time as long as it is not unreasonable. I am of the opinion that it was not unreasonable,” said Asmabi.

She added that it was the prosecution's discretion to decide who should be prosecuted and the law did not require that the principal offender to be charged together with the abettor.

Surendran later told reporters that his client would consider filing an appeal against the dismissal and a civil suit against the two RMAF majors.

Tharmendran, 42, who was re-arrested by the RMAF on Nov 25, was present in court and escorted by a RMAF Provost Marshall team. He is currently held at Batu Kentomen camp detention centre.

On Jan 6, he claimed trial to a charge of abetting the theft of two F5 jet engines that belonged to the RMAF from the Material Processing Shed Matra 1, RMAF base in Sungai Besi, on April 30, 2008.

He can be jailed up to 10 years and fined if convicted.

Nampaknya dengan JV Kamaz, kemungkinan perancangan DRB-Hicom untuk memenuhi permintaan segmen Trak 20tan keatas termasuk Low Loader. Handalan plak kekal untuk segmen 3 tan.

BA KELALAN: Lun Bawangs returning to Ba Kelalan Highlands this Christmas can look forward to a safer and smoother ride when work using soil stablisation technology on the road surface are completed.

Prime mover Royal Engineering Regiment of the Malaysian Armed Forces, has targeted to complete soil stabilisation of the 75km Long Luping-Ba Kelalan Road before this Christmas if weather permits while tar-sealing is scheduled to be completed by January although delivery date is April next year.

The two-phase RM60 million project, started last Aug 1, is the result of a collaboration between the Prime Minister’s Office, Armed Forces (under its Jiwa Murni programme), related government agencies and the local community.

According to First Staff Officer Lt Col Falulin Senan and project manager Major Khamis Salim, their men also worked at night to ensure that the road would be completed in time for Christmas.

They revealed this when giving a briefing to Datuk Shahlan Ismail, a political secretary to the Prime Minister, and his entourage at the site on Sunday.

The entourage flew from Miri to the project site at Lapukan between Long Luping and Ba kelalan and was impressed by the efforts made despite the huge challenges posed by the weather, terrain and logistics.

“We appreciate the efforts, sacrifices and cooperation of all those involved in this project and this would be a landmark and legacy of the engineering corps,” Shahlan said.

Shahlan later presented RM3,000 from the Prime Minister’s Rahah Foundation as an appreciation for the military personnel who had been working very hard to get the road ready as soon as possible.

The Lok Kawi Camp-based engineering corps had to overcome an uphill battle due to inclement weather and logistics limitations to bring in materials for the project and construction of 10 bridges.

The corps and its contractors also engaged locals who had been cooperative and supportive, for which Major Khamis was grateful.

“We are also asking them to pray for good weather as this is our biggest challenge apart from the soil conditions,” he said.

27 Thais and Malaysians killed in Simpang Pulai bus crash

IPOH: A bus carrying Thai tourists crashed and overturned today as it came down from Cameron Highlands, killing 27 people and injuring 10 in what is believed to be the worst road accident in Malaysian history.

Twenty-two of them died on the spot in the accident at Km15 of the Cameron Highlands-Simpang Pulai Road after the double-decker tour bus crashed onto the divider, went across to the opposite lane and overturned in a ditch, said Perak deputy police chief Datuk Zakaria Yusof.

Four people died as they were being rushed to hospital and one person died at the Raja Permaisuri Bainun Hospital here, he told reporters at the scene.

Three of those killed were Malaysians, he said, adding that one of them was the bus driver Omar Shahidan, 48, another a tour guide of Siamese descent Soontorn a/l Kian, 38, and the third a yet-to-be-identified co-driver.

Fifteen of the dead were women.

Zakaria said the bus was heading from Cameron Highlands to Kuala Lumpur because it was believed that the tourists were to have boarded a flight from the Malaysian capital to Bangkok.

Preliminary investigation indicated that the driver lost control of the vehicle and it crashed onto the road divider, went across to the opposite lane and overturned into a ditch.

He said the police and Fire & Rescue Department were summoned at about noon and they deployed 100 personnel in the rescue operation.

Zakaria said there were 37 people in the bus bearing registration number AFX 2266 belonging to San Express Holiday registered in Perak and operating out of Changloon, Kedah.

San Express Holiday managing director Sor Eng Hock, who is in Bangkok on business, said when contacted: "I am very sad ... I am shocked."

He said he would have to come back to the country to find out what exactly happened.

The bus company was registered in 2007 and its six buses had never been involved in major accidents, he said.

Replying to a question, Sor said he would have to discuss some form of compensation for the victims.

The Cameron Highlands-Simpang Pulai Road, which has many curves and gradients, was opened to traffic in 2003. It is an alternative road to the highlands, the original one leading from Tapah.

The new road is usually used by motorists heading for Gua Musang through Lojing in Kelantan.

Today's accident is believed to be the worst in Malaysian history. The previous major road accident occurred on Aug 13, 2007, when 20 people were killed and nine injured in a bus accident at KM229 of the North-South Expressway in Bukit Gantang near Taiping, also in Perak.

Name list of victims

IPOH: The police have issued the names of 24 Thai nationals and two Malaysians who were among the 27 people killed in a tour bus accident at Km15 of the Cameron Highlands-Simpang Pulai Road at 11.40am today.

1. Omar Shahidan, 48 (male, Malaysian bus driver)
2. Soontorn a/l Kian, 38 (male, Malaysian tour guide of Siamese descent)

mengingat kan aku pada zaman pertengahan 90an... dimana kemalangan yg melibat kan bas mcm pisang goreng panas, tak sampai pun seminggu, eh ada lagiii..... gara2 ketamakan sebuah sayrikat pengangkutan, sehinggakan kualiti pemandu yg diambil utk bekerja tolak tepi.....
